1. Introduction
Welcome to Gaon NASP , an integrated agri-commerce and livestock trading platform developed and operated by Bharat Gaon AgriSustain India Pvt. Ltd.
These Terms and Conditions (“Terms”) govern the participation of merchants (“Seller”, “Merchant”, or “You”) on the Gaon NASP platform.
By registering as a merchant, you agree to abide by these Terms along with Gaon NASP’s Privacy Policy, Shipping Policy, and all other platform regulations.
2. Merchant Registration & Eligibility

Only legitimate business entities such as companies, FPOs, cooperatives, partnerships, and individuals with valid government-issued identification may register.

Merchants must provide correct details including GSTIN, PAN, business license (if applicable), bank account, and contact information.

Bharat Gaon AgriSustain India Pvt. Ltd. reserves the right to verify, suspend, or reject any registration at its discretion without prior notice.
3. Product Listing & Pricing

Merchants shall list only authentic, legally compliant, and quality-assured products or services.

All product details — name, description, specifications, and pricing — must be accurate and transparent.

Prices must include all applicable taxes and comply with the Legal Act and GST rules.

Misleading listings, fake reviews, or counterfeit goods are strictly prohibited.

Gaon NASP reserves the right to modify, delist, or reject any product that violates platform policy.
4. Order Management & Fulfilment

Merchants are responsible for timely processing, packaging, and dispatch of orders.

Shipping costs, timelines, and delivery responsibilities must be clearly defined.

Failure to fulfill an order on time may result in penalties, refunds, or suspension.

Product quality and quantity at the time of dispatch shall be solely the merchant’s responsibility.
5. Payment & Settlement

Payments for completed orders shall be transferred to the merchant’s registered bank account after deducting applicable service fees, commissions, and taxes.

The standard settlement cycle is T+7 to T+15 business days, depending on product category and payment method.

Bharat Gaon AgriSustain India Pvt. Ltd. may withhold or adjust payments in case of disputes, chargebacks, or policy violations.
6. Fees and Commissions

Gaon NASP charges a commission/service fee per transaction, communicated during onboarding.

Any changes in fees will be notified via email or portal updates.

Merchants are solely responsible for paying applicable taxes on their earnings, including GST .
7. Returns, Refunds & Disputes

Merchants shall comply with Gaon NASP’s customer return and refund policy.

In case of disputes or defective goods, merchants must cooperate to resolve issues promptly.

Frequent customer complaints or poor service quality may lead to suspension or termination.
8. Compliance & Legal Responsibility

Merchants must comply with all applicable Indian laws, including those related to agriculture, food safety, livestock trading, environment, and e-commerce.

Selling prohibited, expired, or unlicensed items (e.g., banned chemicals, unregistered seeds, or unapproved animal breeds) will result in immediate termination.

Bharat Gaon AgriSustain India Pvt. Ltd. shall not be held responsible for any legal violations by merchants.
9. Intellectual Property

Merchants must ensure they own or have permission to use all brand names, logos, and product images they upload.

Gaon NASP reserves the right to remove any listing that infringes on third-party intellectual property rights.
10. Data Privacy & Confidentiality

All merchant and customer data shall be handled per Gaon NASP’s Privacy Policy.

Merchants shall not misuse customer data or engage in direct marketing outside the platform.
11. Suspension or Termination of Account
Gaon NASP may suspend or terminate merchant accounts without notice for:

Policy or legal violations,

Fraudulent or unethical practices,
-
Repeated customer complaints, or
-
False or misleading business information.
12. Limitation of Liability
The platform and its owner provide services on an “as-is” and “as-available” basis.
Bharat Gaon AgriSustain India Pvt. Ltd. shall not be liable for any indirect, incidental, or consequential loss arising from merchant activity or platform downtime.
13. Amendments
Bharat Gaon AgriSustain India Pvt. Ltd. reserves the right to update these Terms at any time.
Continued use of the platform after updates constitutes acceptance of the revised Terms.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts located in Gaya, Bihar.
